What is Privacy Shield?
Earlier in April, Instana has successfully certified its commitment and adherence to the Privacy Shield Principles to the U.S. Department of Commerce’s International Trade Administration (ITA) and is now an official EU-U.S. Privacy Shield Participant. This follows our SOC 2 compliance.
Why should one care?
GDPR requires EU entities to establish appropriate safeguards for transatlantic data transfers for commercial purposes. While the Standard Contractual Clauses can be one way in ensuring appropriate safeguards are met, the Privacy Shield Framework can do the same in a less complex more practical way.
Background of the Privacy Shield Framework
The EU-U.S Privacy Shield Framework was negotiated back in 2015/2016 and enables certified US-companies and related EU entities to exchange personal data being under protection of the General Data Protection Regulation (GDPR) from the EU to the U.S. The framework comes with a set requirements covering several aspects of the GDPR such as transparency, security and accountability. These requirements are becoming enforceable under U.S. law. Privacy Shield Participants must recertify to the ITA on an annual basis.
